4th day of June in the year of our Lord One thousand seven hundred & eighty two. In the Name of God Amen. I Matthew Duty of Caswell County and the State of North Carolina do make ordain and constitute this my last
will and testament. I will and bequeath unto my beloved son William Duty my Sourill Mare, one cow and calf one Sow and Piggs and three hundred w. of Pork at the fall to be made out of the Stock of Hogs also six pounds in money. I will unto my beloved son Solomon Duty One Bay Horse I bought of Richardson Owen, one Cow and Calf when he may come to the age of Twenty One years and until then to remain on the Plaintation for the use of the same. I will unto my beloved Brandson William Owen One Pide Cow and Calf also one red Heffer and Calf. I will that Twenty Six Shillings be made into four rings, one for my beloved Wif and each of my Daughters, Sarah Owen, Mary Duty and Ann Duty. I will and Bequeath unto my Beloved Wife One Third Part of my Land during her natural life. I will that all debts due me be collected as soon as Possible and all Lawful Demands Discharged. Then the Ballance with the Ballance of cash in hand to be laid out to the Best Advantage in one or more Negroes the remainder of my Estate Both Real and Personal I lend unto my Beloved wife for the use of raising supporting and Learning my young children until my son Thomas Duty come to the age of Twenty One years if she Remains my widow. Otherwise to be Taken away and Taken care of by the Executor and be it as it may. When my son Thomas comes to the age of Twenty one I will that my land be sold and the amount with Negroes or Negroes and the Remainder of Stock of all kinds Household Goods & Furniture be Valued or Praised and I will that each of my sons John Duty Littleton Duty Thomas Duty to have Twenty pounds each and I will that my Daughters Mary Duty and Ann Duty each and I will that the remaider be equally Divided amongst my sons William Duty Solomon Duty Richard Duty John Duty Littleton Duty Thomas Duty and my Daughters Mary Duty and Ann Duty and Lastly I do appoint my Beloved Son William Duty my Trusty friend John Adams and Charles Littleton my soul Executors to this my Last Will and Testament & in Witness Whereof I have herunto set my hand and have affixed my seal in the presence of Richard Owen, James Stuart, Joseph Turner. In the Name of God Amen. I Richard Duty of Knox county State of Indiana being weak in body but sound in mind and reflectin that all men must die do make & ordain this as my Last Will & Testament first it is my express will & desire that all my just debts should be punctually paid. And to my beloved wife I give and bequeath the use of the farm whereon I now reside. Which I hold by virtue of a permission from the government of the United States during her natural Life or widowhood.
Third whereas I have heretofore given unto my children married that is to say Nancy Harvey Amy Stokes John Duty now Deceased and Polly Baldwin at the time of their marriage but as written manifestation of my Love and Respect for them I give to each of them that is to say Nancy Harvey one dollar Amy Stokes one Dollar and the legal Heirs of John Duty deceased the sum of one Dollar and Polly Baldwin the sum of one Dollar.
To my daughter Sarah Ann Duty I give and bequeath guthries Geography.
The remainder of my property after my wife takes out her third part I will and bequeath unto my children Rachel McChord Patsy Parker Sarah Ann Duty Thomas Duty Elizabeth Duty Wm. Duty Richard Duty Lucy Duty Sussannah Duty and Catherine Duty to be equally divided among them but it is to be understood that Rachel McChord and Patsy Parker having each received on bed and furniture the price thereof to be included in their part.
As several of my children are small and have not received their education it is my wish that no immediate division of my property be made but that my wife have the use thereof to enable her to educate my children during her widowhood or until my youngest child arrives to the age of eighteen but should my wife again marry in that case I wish division to take place and it is my further desire that as my eldest children marries or arrives at the age of twenty one that they should have such parts of their portions as can be shared to them without distress to the remainder of the family.
To my son Wm Duty I give my Rifle gun.
To my son Richard Duty I give and bequeath my shot gun.
And lastly I constitute and appoint my trusty friend Joseph Chambers executor and my Beloved wife Sally Duty executrix of this my last Will and Testament In witness whereof I let my hand to witness this fourth day of January in the year of our Lord one thousand eight hundred and twenty two in the presence of John Chambers Joseph Medley. I John Pinson Planter knowing it is appointed for all men once to die do hereby declare this to be my last will & testament...I give & bequeath unto my loving wife Betsey Pinson three Negroes Nan, fillis & Nail three cow & calves two fether beds & furniture and such part of my kitchen furniture as my executrix shall think sufficient for her use & ? House during her natural life.
To John Pinson my son I give & bequeath the tract of land lying where I formerly lived supposed to be one hundred & thirty acres bound ? On the tract I now live on. By Howard Pinson Jonathan Johnson & the Mr. Cunninghams lands at the death of my wife to him his heirs assign forever. And one equal part of my personal estate. To my son Howard Pinson I do give & bequeath one equal part of my personal estate to him his heirs & assign forever. To my son Thomas Pinson I also give & bequeath one equal part of my personal estate to him his heirs and assign forever. To Aaron Pinson my son I also give & bequeath the tract of land whereon I now live supposed to be one hundred and thirty acres and one equal part of my personal estate to him his heirs and assign forever. He is to have possessioin of the said land at the death of my wife. To my son in law William Strain I also give & bequeath one equal part of my personal estate but if he should die without issue his part to return back to my legatees. Also to my son in law Richard Duty I give & bequeath one equal part of my personal estate except the sum of one hundred and twenty dollars he is due me to him his heirs assign forever. To Cornellius Pucket my son in law I give & bequeath one equal part of my personal estate to him his heirs and assign forever. Also to my son in law Thomas Weathers I give & bequeath one equal part of my personal estate except fifty dollars he is due me to him & his heirs forever. And I do hereby terminate constitute & appoint my two sons Howard & Thomas Pinson executors of this my last will & testament and do hereby direct and require them at the finishing of the present crop after my death to proceed to sell all my personal estate except what is willed herein to my wife on a credit of one year from the sale thereof and when the amount of said sale and all debts due me & after paying all lawful debts I owe then to pay off said legacies as about directed. And at the death of my wife they my said executors are to sell what I have left to my said wife on the same credits and pay each legatee his part as is directed by this my will. In witnes whereof I have hereunto set my hand & seal this 26th day of June in the year of our Lord 1811 and in the thirty fifth year of the American Independence signed sealed and pronounced by the said John Pinson as for his last will & testament revoking all other His R Mark
